Welcome to the website of Peak Theatre Arts, LLC (“Peak,” “we,” “us,” or “our”). These Terms & Conditions (“Terms”) govern your use of our website, digital content, programs, services, and any purchases made through our site (collectively, the “Services”). By accessing or using our Services, you agree to be bound by these Terms. If you disagree, please discontinue use of our site immediately.

1. Eligibility

You must be at least 18 years old to use our Services or enroll a child in any program. Parents/guardians may use the site and register minors for youth programs.

2. Program Enrollment & Participation

By enrolling in any Peak Theatre Arts program, you agree to:

• Provide accurate and complete registration information

• Ensure the child you enroll meets program requirements

• Abide by all program policies, safety guidelines, and site rules

• Notify Peak promptly of any changes to your contact or emergency information

Failure to comply may result in removal from a program without refund.

3. Payments & Billing

All fees for programs, workshops, camps, or digital products must be paid in full at the time of registration unless otherwise stated.

Peak Theatre Arts uses secure, third-party payment processors. By making a purchase, you authorize the relevant processor to charge your selected payment method.

We do not store complete credit card information.

4. Refund Policy

Unless a specific program or product lists its own refund terms, the following applies:

• Program fees are non-refundable unless Peak cancels the program.

• Refund requests due to illness, schedule conflicts, or personal reasons are considered at Peak’s sole discretion.

• Digital products, downloads, and resources are non-refundable once delivered.

Peak reserves the right to issue partial, full, or no refund based on circumstances.

5. Intellectual Property

All content on this website—including lesson plans, curriculum materials, images, videos, logos, branding, workshops, text, and digital products—is the exclusive property of Peak Theatre Arts, LLC and is protected by copyright and intellectual property laws.

You may not:

• Reproduce

• Distribute

• Modify

• Share

• Sell

• Upload

• Publish

• Claim ownership of

any materials without our express written consent.

Unauthorized use may result in legal action.

6. User Conduct

Users agree not to engage in activities that:

• Violate any law or regulation

• Interfere with website functionality

• Attempt to access unauthorized parts of our systems

• Upload harmful code, malware, or malicious scripts

• Misuse or reproduce Peak’s intellectual property

Peak reserves the right to suspend access for any user violating these provisions.

7. Photo & Video Release

By participating in Peak programs, you acknowledge that:

• Peak may capture photos or videos of classes, performances, and workshops

• These images may be used for educational, promotional, or archival purposes

• You may opt out by submitting a written request to jessica@peaktheatrearts.com before the program begins

Parents/guardians are responsible for notifying us in writing regarding their child.

8. Third-Party Services

Our website may contain links to or use integrations from third-party platforms (e.g., Wix, MailerLite, YouTube, Stripe). These services are governed by their own terms and privacy policies.

Peak is not responsible for the practices or content of third-party websites.

9. Limitation of Liability

To the fullest extent permitted by law:

• Peak Theatre Arts is not liable for indirect, incidental, or consequential damages

• Peak is not liable for injuries, property damage, or losses arising from participation in any program

• Participation in physical activities carries inherent risks; parents/guardians assume responsibility for enrolled minors

If Peak is found liable for any claim, our maximum liability shall not exceed the total amount paid by you for the service in question.

10. Indemnification

You agree to indemnify, defend, and hold harmless Peak Theatre Arts, LLC, its directors, employees, teaching artists, contractors, and affiliates from any claims arising from:

• Your use of the Services

• Your breach of these Terms

• The actions of any minor you register

11. Changes to These Terms

We may update or revise these Terms at any time. Changes take effect immediately upon posting. Continued use of our website or services constitutes acceptance of the revised Terms.
